| Police Arrest Man for Fourth Offense DWI |

SEPTEMBER 2011, Calcasieu Parish, Louisiana—A Louisiana State Trooper received a phone call from a concerned motorist reporting a reckless driver on Interstate 10. Troopers tried to stop the vehicle but the driver refused to stop. After a 6 mile pursuit, troopers stopped the vehicle. The driver, Gerald J. Kowal of Flagstaff, Arizona appeared to be impaired and troopers placed him under arrest. After being taken to State Police Troop D, Mr. Kowai refused a chemical test. Troopers then obtained a "no refusal" search warrant and Kowal was taken to an area hospital where blood was drawn. The test results are pending analysis. When an impaired driver refuses to submit a chemical sample for analysis, a "no refusal" search warrant can be obtained. Troopers provide information to a judge on call who examines the circumstances involved. If the judge then determines that probable cause exists, he tsigns the search warrant allowing troopers to obtain a chemical sample to determine impairment. Kowal was charged with DWI 4th offense, flight from an officer, following too close, improper lane usage, no driver's license, and no seat belt. Mr. Kowal was booked into the Calcasieu Parish Correctional Center. Motorists are encouraged to report impaired or reckless drivers, by dialing *LSP (*577) from their cellular phone or contacting their local law enforcement agency.
